INTENTION TO VIEW PROPERTY
Agent is holding an open house or conducting in-person or live virtual tours of the property identified above.
The visitor is interested in viewing the property. The Agent agrees to show the property to the Visitor under the following terms and conditions:
1. AGENT DOES NOT REPRESENT VISITOR
Unless otherwise agreed in writing, the Agent is not working with and has not entered into a representation agreement with the Visitor that would apply to the property.
2. COMMUNICATION WITH AGENT IS FOR THE BENEFIT OF THE SELLER
Any communication or exchange of information between the Agent and the Visitor during the open house or property tour is for the benefit of the seller. All actions taken by the Agent—regardless of any assistance provided to the Visitor—are done solely to benefit the seller.
3. COMMUNICATIONS ARE NOT CONFIDENTIAL
Any information shared by the Visitor with the Agent during the open house or property tour may be disclosed to the seller.
4. OFFER THROUGH AGENT
If the Visitor writes an offer on the property through the Agent, the Agent will then disclose whether they represent the seller exclusively or both the seller and the Visitor.
5. REPRESENTATION BY THE AGENT HOLDING THE OPEN HOUSE
If the Visitor wishes to be represented by the Agent holding the open house, they must sign a formal representation agreement such as:
• Property Showing and Representation Agreement (C.A.R. Form PSRA)
• Buyer Representation and Broker Compensation Agreement (C.A.R. Form BRBC)
Note: If the Visitor is already in an exclusive relationship with another agent, this is not intended as a solicitation.
